Welcome to The Happy Plant Project. We provide our Product to you under the following Terms of Use (“TOU”), which may be updated by us from time to time without prior notice. When using specific services owned or operated by The Happy Plant Project, you and The Happy Plant Project are subject to any posted guidelines or rules relevant to those services, which may be posted periodically. These guidelines and rules, including our Spam Policy, are hereby included by reference into the TOU. The Happy Plant Project may also offer other services governed by distinct Terms of Use.

Product Description:
The Happy Plant Project, through its website, empowers users to facilitate tree planting and dedication through its eTreeCertificates® for greetings or carbon offsetting (the “Product”). Users can choose to purchase trees in bulk and hold them in a PlantBank until they decide to use them for greetings or carbon offsetting. Here are some key points to consider:

• The Happy Plant Project is a social venture aimed at making a significant positive impact on the planet but is not a nonprofit organization.
• The Happy Plant Project issues a maximum of one certificate for each tree planted, and a certificate can only be created if one or more trees are planted. Users can choose to send the certificate to a recipient of their choice or to themselves. Trees will be planted around the time of the transaction, but planting may be delayed due to seasonal constraints or unforeseen on-ground challenges. The Happy Plant Project reserves the right to arrange tree planting up to eighteen months after the transaction date or up to thirty months before. The Happy Plant Project will never sell a tree twice.
• Trees planted by The Happy Plant Project are on public lands, and necessary permissions from the landowner (e.g., Village Gram Panchayat or State Forest Department) are secured.
• The Happy Plant Project’s planting partners have extensive experience in tree planting and have received awards for their work. They make every effort to ensure the survival of trees. However, The Happy Plant Project cannot be held responsible for tree loss due to disease, natural disasters, or illegal activities. Planting partners often use rootstock regeneration to compensate for lost trees.
• Independent auditors appointed by The Happy Plant Project verify that planting partners plant trees according to instructions.
• The Happy Plant Project does not issue carbon credits.
• Users do not own the trees they plant, and The Happy Plant Project does not arrange site visits. However, the location of the planted tree can be provided, allowing users to visit independently.
• To maximize tree planting, The Happy Plant Project does not track individual trees to specific users, although users can choose the project, location, or social impact for their trees. The Happy Plant Project may occasionally plant trees in a different location or project based on exigencies.
• The Happy Plant Project cannot be held responsible for the scientific accuracy or reliability of information it provides on its properties, although it makes every effort to obtain reliable information. The Product may include necessary communications from The Happy Plant Project for satisfactory completion of the Product.

Your Registration Obligations:
By using the Product, you represent that you are of legal age to enter into a binding contract and are not barred from receiving products or services under the laws of India or any other applicable jurisdiction. You agree to:

(a) Provide accurate, current, and complete information about yourself as prompted by the Product’s registration form (the “Registration Data”).

(b) Maintain and promptly update the Registration Data to keep it accurate and current. Providing false, inaccurate, outdated, or incomplete information may result in the suspension or termination of your account and the denial of future Product use.
